By using our website at concreteamherst.com or by engaging Amherst Concrete to perform any work, you agree to be bound by these terms and conditions. If you do not agree, please do not use our website or engage our services. We reserve the right to update these terms at any time, and continued use of the site or our services after any change constitutes acceptance of the updated terms.
Amherst Concrete is a concrete contractor providing residential and commercial concrete services in Amherst, MA and surrounding communities. Services include, but are not limited to, concrete driveways, patios, sidewalks, foundations, retaining walls, pool decks, floors, and related work.
Our website provides general information about our services and a way to contact us. The website does not constitute a binding service agreement. An agreement is formed only when both parties have signed a written contract or estimate authorization.
All estimates provided by Amherst Concrete are based on information available at the time of the site visit and are valid for 30 days from the date issued, unless otherwise noted in writing. Estimates may be subject to change if site conditions, scope of work, or material costs change materially between the estimate and the start of work.
Work will not begin until both parties have agreed to a written estimate or contract. Any changes to the agreed scope of work must be documented in a written change order before additional work proceeds.
Amherst Concrete is not responsible for price changes resulting from conditions not visible or reasonably foreseeable at the time of the estimate, including subsurface conditions, hidden utilities, or changes in material availability.
Project scheduling is subject to crew and equipment availability, weather conditions, permit timelines, and other factors. Amherst Concrete will provide a good-faith estimated start date but cannot guarantee specific start or completion dates, particularly for projects affected by permit delays or adverse weather.
Concrete cannot be safely poured in freezing conditions. Amherst Concrete reserves the right to reschedule any pour that would be adversely affected by temperature or weather without penalty to either party.
If you need to cancel or reschedule a confirmed project, please provide at least 48 hours notice. Cancellations made with less notice may be subject to a fee for materials already ordered or crew time already committed, as described in your written agreement.
Payment terms are specified in the written estimate or contract for each project. In general, a deposit may be required before work begins, with the remaining balance due upon project completion unless otherwise agreed in writing.
Invoices not paid within the timeframe specified in the written agreement may be subject to a late payment fee. Amherst Concrete reserves the right to place a mechanic's lien on the property in accordance with Massachusetts law if payment is not received.
Accepted payment methods are specified in the written estimate. Payment in full is required before we will release any warranty documentation or completion certificates.

Amherst Concrete is not liable for damage to unmarked underground utilities or for delays caused by a failure to clear the work area as agreed.
Any warranty on completed work will be described in the written contract for your specific project. Unless a written warranty is provided, all work is delivered in an "as-is" condition.
Concrete is a natural material and minor surface cracking along control joints is normal and expected over time. This is not a defect. Warranty claims do not cover damage caused by improper maintenance, use of de-icing salts not recommended by the contractor, vehicle loads exceeding those specified in the estimate, or acts of nature.
The website and its content are provided "as is" without warranties of any kind, express or implied. Amherst Concrete does not warrant that the site will be error-free or continuously available.
To the fullest extent permitted by applicable law, Amherst Concrete will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to our services is limited to the amount paid by you for the specific project to which the claim relates.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any legal action relating to our services or these terms shall be brought in the appropriate courts of Massachusetts.
These terms and conditions are governed by and construed in accordance with the laws of the Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.
